Jose A. Rodriguez is a senior associate with the firm whose primary areas of practice are business and construction law. Mr. Rodriguez represents owners, general contractors, subcontractors, suppliers and materialmen in all phases of construction matters, both before and after a lawsuit is filed. Mr. Rodriguez has assisted and represented clients in lien claims, state and federal bond claims, construction defects, delay claims and breach of contract claims. In addition, Mr. Rodriguez has also represented clients in construction related bankruptcy matters such as preference actions, reclamation demands and fraudulent transfer claims.
 
Mr. Rodriguez earned a Bachelor of Arts from Florida International University where he went on to receive a Master's Degree in History. Mr. Rodriguez then went on to earn his Juris Doctor from the University of Miami where he served as a teaching assistant and president of the Honor Council.

Significant Matters:

Successfully defended a national steel supplier from a preference/turn over debt claim in excess of $750,000. The Trustee sought payment for materials fabricated and invoiced to the client prior to the filing of the bankruptcy. Utilizing defenses under the bankruptcy code and applicable Uniform Commercial Code, our litigation team achieved a favorable outcome for the client.
 
Successfully defended a national steel supplier from a 11 U.S.C. 547 action by a Trustee seeking recovery of $250,000 in preferential payments. Utilizing defenses under the bankruptcy code our litigation team negotiated a settlement for a fraction of the exposure.
 
Assisted a national steel supplier having over $500,000 in both pre and post petition debt navigate the customer's bankruptcy. Our litigation team secured court recognition of the client as a critical vendor, procuring payment on future sales while pursuing payment on delinquent invoices through the court and lien/bond interests on related construction projects.
